Otherwise, the trip will not take place.
Assumption of Risks, Waiver, Release & Indemnity Agreement
For valuable consideration, including the acceptance and my participation in the complementary cruise on Le Corse, I hereby agree to the following:
REPRESENTATIONS AND WARRANTIES:
By participating in the cruise on Le Corse, I represent and agree that I will follow all rules, regulations, and instructions from the Captain. I also confirm that I am physically fit and have no medical or health conditions that would prevent me from sailing.
ASSUMPTION OF RISKS:
I understand that sailing has inherent risks that can’t be eliminated, regardless of the precautions taken to avoid injuries. I acknowledge that these risks are part of my participation and that I am voluntarily assuming all of them.
WAIVER, RELEASE, DISCHARGE AND COVENANT NOT TO SUE:
I, on behalf of myself, my heirs, and representatives, release and waive any claims against Le Corse and its members, volunteers, and agents (referred to as “Affiliated Parties”). This includes claims for personal injury, accidents, illnesses, or property loss that may result from my participation, even if caused by the active or passive negligence of Le Corse or any of the Affiliated Parties. I also agree not to sue them for any of these issues.
INDEMNIFICATION AND HOLD HARMLESS:
I agree to indemnify and hold Le Corse and the Affiliated Parties harmless from any claims, suits, or liabilities, including attorney’s fees, that arise from my involvement in sailing aboard Le Corse. I will also reimburse them for any expenses they incur as a result.
PUBLICITY:
I give permission to Le Corse and its sponsors to use any photos or videos of me from the cruise for any purpose they consider appropriate, including distribution in sailing publications and other media outlets.
GOVERNING LAW, COURTS:
This agreement is governed by the laws of the State of California. Any legal action regarding this agreement must be brought in the courts of Santa Clara County, California.
ACKNOWLEDGMENT OF UNDERSTANDING:
I have read and fully understand this agreement’s terms, including that I am
giving up substantial rights, such as my right to sue. I understand that I can consult with an attorney before signing this agreement. I am signing this voluntarily, and my signature is an unconditional release of all liability to the maximum extent allowed by law.
